Conjestina Achieng' retires to the village

“I was called by someone from Nairobi that Conjestina was picking up leftovers from rubbish bins and eating for lack of food,” said Conje’s father Clement Adala.

This was the matter that forced him to take his daughter away from Nairobi back to Siaya County.
For the past one month, Kenya’s top female pugilist  has been staying with her parents at their Umiru village, Nyamninia sub-location in Siaya. She had left Nairobi after apparently failing to take care of herself and because her condition was becoming worse having suffered mental disorder earlier.
When The Nairobian team visited her in Umiru village, her parents looked sad. They kept looking at their daughter, who was once a boxing champion, but is now unable to even fend for herself or even communicate sensibly. Conje together with her only son are staying at home surviving on the little they can get from their parents.
Last year her condition made her to be taken to Mathari Hospital, a matter that made her pause her boxing career that had already started flourishing.
Adala showed The Nairobian a letter from Mathari Hospital dated June 18 that indicated Conje was diagnosed with schizo-affective disorder/paranoid schizophrenia. She was admitted to Mathari last September 8 after she relapsed in a psychotic episode.Conje had earlier been treated for the same in January 2011 but apparently she relapsed after failing to take her medication citing lack of funds.
On review on June 17, she appeared calm but in a depressed mood. “There was no psychotic features and it was reported that she had stopped taking drugs after they got finished and could not be bought due to lack of money,” said Adala.
Mathari consultant psychiatrist, Dr Nelly Kitazi advised her to undergo counselling individually and with her family.
Apart from that, Conje was advised to resume her medication and engage in gainful employment. Her father said Conje stopped taking medication because of stress and also after the prescription elapsed they could not afford to buy the drugs.
In a letter dated September 6 last year addressed to Mathari Hospital medical superintendent on admission to the institution, Dr Ngugi Gatere said ‘Conje’ was talking a lot, aggressive, lacked a lot of sleep and refused to take medication prescribed for her.
When she was interviewed she had hallucinations that directed her on what to do. She claimed to have a clock in her head that directed her on what to do and that “aeroplanes” were monitoring her movements.

Are you safe with that tattoo?

Tattoos, in other words body art, are more common than ever before. Walking along the city streets exposes you to a barrage of tattooed Nairobians keen to show off their body artwork. Some will even risk indecent exposure to give a glance of tattooing in some unimaginable places! And more tattoo studios are coming up by the day.

But don’t let the ease of getting tattoos stop you from making a thoughtful decision about permanent body art. Before you get a tattoo, be clear about what’s involved and be certain that tattooing is the right decision for you. Tattooing is not without health risks – make sure you understand the risks and basic safety precautions.
A tattoo is a permanent design made on your skin with pigments inserted through pricks into the skin’s top layer. The tattoo artist uses a hand-held machine that acts much like a sewing machine, with one or more needles piercing the skin repeatedly. With every puncture, the needles insert tiny ink droplets.
The process causes a small amount of bleeding and some pain. The breaching of the skin raises the potential for allergic reactions, infections and longer-term skin conditions associated with scarring referred to as keloids. At worst, contaminated tattoo equipment can transmit blood borne diseases like Hepatitis B and C, and even HIV.
Various strategies can help reduce health risks associated with tattoos. We could borrow a leaf from the most tattooed nation, the UK, and legislate on licensing of tattoo studios. Tattoo licences can be restricted to only trained tattooists, and their studios must surpass the threshold of health and safety.
The tattoo artist must disinfect their hands and wear protective gloves for every customer. Non-disposable equipment must be sterilisable. And tubes and needles must always be from sealed packages before the next customer’s tattooing begins. Any leftover pigments, trays and containers from a previous customer should always be discarded.
You as the customer should also dictate your own tattoo safety standards. Do not allow yourself to be pressured into getting a tattoo, and certainly don’t get a tattoo when under the influence of alcohol or drugs. Choose your tattoo studio carefully. Make a decision whether your tattoo should be visible or hidden under your clothing. Remember weight gain, including pregnancy, can distort or otherwise affect the appearance of your tattoo.
Take good care of your tattoo. It can take up to two weeks for the skin to heal. Keep the tattooed area clean, well moisturised and free from tight clothing or direct sun exposure. If any signs of poor healing or infection occur, please see your doctor promptly. Occasionally, tattoo removal may become necessary so please consult a dermatologist about laser surgery or other removal options.
A tattooed body can appeal in many ways, but be wary of tattooing yourself to some unwanted disease.

Muiruri said that the irate residents started screaming and taunting the man in a bid to rescue the goat.
The residents then descended on the man with blows and kicks as a way of punishing him for his behavior.
However officers from Karamai police station arrived at the scene and rescued the man from the mob.
Joseph Gathuri, the owner of the goat, said he left the goat grazing in a thicket.
Moments after he left, he was shocked to receive information about what his goat was going through.

The ‘little shopkeeper’ who had Mzee Jomo Kenyatta jailed

Jomo Kenyatta
Founding president was convicted largely due to the false testimony of Rawson Macharia

Kenya: ‘Frail, little Kikuyu shopkeeper’, that is how Time magazine described the star witness who provided false testimony against Kenya’s founding President, Jomo Kenyatta and got him convicted during the Kapenguria trials in 1953.
These memories will be replayed as the country celebrates 35 years since Kenyatta’s death today.
Attention will also be focused on his trials in Kapenguria alongside five other nationalists. Despite his role in the saga, Rawson Macharia has always escaped attention.
The trial, which took place in 1953, was dubbed the most notorious in Commonwealth history. But unknown to many, the colonial administration that was behind it was so short of evidence to convict Kenyatta and his co-accused that they had to rely on false evidence to prosecute.
Proceedings of the case stored at the Kenya National Archives shows that the colonialists relied on Macharia to nail Kenyatta.
On March 16, 1959, Time magazine wrote: “Star witness Rawson Mbogwa Macharia, a frail little Kikuyu shopkeeper, testified six years ago that Kenyatta himself had administered the Mau Mau oath on him, that he had been stripped naked and made to walk seven times through an arch of banana leaves and to drink human blood.”
Plane ride
The magazine reported that Macharia showed newspapers editors in Nairobi a letter sent to him from the then Attorney General written before the trial.
In return for his testimony, the letter said, the government would reward Macharia with a round-trip plane ride to England, a two-year college course in public administration, protection for his family when he was away, and a government job when he got home.
“The Kenya government did indeed keep its promise, at a total cost of £1,500, but nothing seemed to satisfy Macharia. Found unfit for one job, he huffily turned down another,” stated the magazine.
Revenge plot
A beer shop that the colonialists helped him to open flopped. Blaming all his troubles on the government, Macharia plotted to hit back.
In November, he signed an affidavit for People’s Convention Party Leader Tom Mboya charging that the Kenya government had paid him to lie.
The colonial government later admitted that it had paid Macharia a retainer fee of £29 per month, but insisted that it had paid him only to testify, not to lie, and promptly put him on trial for signing a false affidavit.

Why do women cheat?

In the yester-years, the news that a woman had cheated on her partner was a scandal of immeasurable magnitude. A woman, once married, was expected to be faithful to her husband, no matter what, ‘until death do us part’. The so-called "cheating gene" was a preserve of men. But that was then.

In one unscientific yet telling poll at womansavers.com, women were asked if they had ever cheated. Of the 9,400 women who responded, 49 per cent said they had. Another 26 per cent said they had had no problem stepping out on their partners if they knew they could get away with it. That is today’s woman. If men thought they had Masters degrees on cheating, women have gone higher up with PHDs.
Miriam has just completed campus and is an intern at a company in Nairobi. She has a boyfriend with whom she has gone steady, but she is cheating on him with her boss."I am doing it in order to get a permanent job. I cannot be an intern all my life. It’s nothing personal, it’s a necessity," she argues.
Blame the husband
Miriam claims that dividing time between her boss and boyfriend is very hard but she is up to it. She does not care that her boss is married; after all she has a boyfriend too.
Some women blame their husbands for their decision to cheat. "I gave my husband everything I had and even quit my job to raise our five children. I was a good wife who was always waiting to serve him even when he came home past midnight. I gave him support and encouraged him when he was low; I was literally his rock. Anything he needed I provided without second thought; but when I found out that he was cheating on me, I lost it. to. In revenge, I had an affair with his closest friend," says a woman who wished to remain anonymous.
"I initially intended it to be a one time thing just to get even, but now later I could no longer control it. I, however, have no regrets. If my husband can cheat on me after everything I did for him, why shouldn’t I also have fun?"
Negligence
You have probably heard that men cheat because of physical reasons but experts have found out that most women cheat because of emotional reasons. Even so, it takes more than mere opportunity to get a woman to slide between someone else’s sheets.
Naomi James, a counselling psychologist and therapist with Oasis Africa, says that women will most likely cheat due to emotional negligence. "Women who feel emotionally neglected by their spouses are easy targets for affairs. If they find empathy elsewhere, they go for it. Men look at issues in a rational way while women are emotionally wired. A careful listening ear will attract a woman toward another man.

Police issue alert over abandoned bombs

MACHAKOS, KENYA: Police in Masinga have issued an alert to area residents following several cases of discovery of abandoned bombs in the area.

Residents within the district have now been cautioned to be extra careful after a live bomb was discovered at Kwa Ndolo village of Kathukini Sub-location on Tuesday morning.
Sources told The Standard the explosive device was discovered by a local farmer while on routine activities in his farm. Police officers who were called in immediately confirmed the device was an 81mm live bomb.
Kithimani OCS David Muli confirmed that the bomb was later detonated by bomb experts from Criminal Investigation Department headquarters.
In an interview with The Standard on Thursday, Mr Muli disclosed that in the past one year, a total of 21 bombs had been discovered area residents although luckily enough no fatalities have so far been reported.
But area residents have expressed fear following the latest discovery, which probably sent a strong signal that more unknown dangerous weapons could still be buried within their neighborhood. “We are worried because this area is now under settlement and one can’t tell where danger lurks,” said a villager who identified himself only as Mutiso.
According to police, the area was used as a military training ground in the early 1970’s, and therefore more of such explosives could be discovered in future. “We are told the area was used by Kenya Army as range area and therefore it’s very possible that more explosives could be discovered,” he said.
“The good news is that we have adequately sensitized the community about the matter and the effort appears to have borne positive results since we have never lost any lives from the abandoned explosives,” he observed.

After a whole day of ridicule yesterday, 'classy' Tujuane chic Eda Atieno most probably did not see this one coming, no one did.
Her KCSE results have been leaked online anonymously, and I don't know what to think of that.

Eda went through Butere Girls High School, sitting for her KCSE in 2010. It turns out books were not her thing.
She got a C, which is not good enough to get you into any university in Kenya, not even Private ones. The minimum grade to join a university in Kenya is C+.
Simply put, she failed.

Furthermore, from the screenshot, Eda's name appears fourth last at position 177.
The national examiner ranks according to students' index numbers, which means Eda was fourth last in their indexing exam.

Here's a screenshot from Butere girls.

Wayne Rooney saga hangs over Chelsea-United clash

Chelsea manager Jose Mourinho's pursuit of Manchester United's unsettled striker Wayne Rooney has added spice to the first big Premier League match of the season when the title rivals clash at Old Trafford on Monday.
The west London club have already tabled two bids for the England forward and have not ruled out making a third, despite new United boss David Moyes's steadfast refusal to sell.

"We have Plans B and C," Mourinho said ahead of Wednesday's home game against Aston Villa, which they won 2-1 thanks to a second-half header from Serbian Branislav Ivanovic.
"Don't ask me names because it's difficult to speak about players from other clubs. We have the conditions to try to improve our team by bringing in one more player and we are going to try that till the end."
The Blues are keen to add to their striking options of Fernando Torres, Romelu Lukaku and Demba Ba but United do not want to sell to a Premier League title challenger despite the form of Robin van Persie and Danny Welbeck, who each scored twice in an opening 4-1 win at Swansea City on Saturday.
Monday's match between two of the Premier League's biggest rivals sees David Moyes in charge of United at home in the league for the first time since replacing Alex Ferguson, a man whose absence the returning Mourinho said would be strange.
"It will be difficult for me, and I think all managers, to go to Old Trafford and play against Manchester United without this mythical figure waiting for us," he recently told Sky Sports.
The match (kickoff 1900 GMT) is part of another busy start to the season for Europa League holders Chelsea, who take on European champions Bayern Munich for the Super Cup in Prague on Friday, a repeat of the 2012 Champions League final.
It is also the first in a tough run of fixtures for former Everton boss Moyes' side, who also play Liverpool and Manchester City in coming weeks, and the Scot will be desperate to make an early mark in front of his new fans at Old Trafford.
Underr fire
Arsenal will look to put their off-pitch woes to one side when they make the short trip to Fulham on Saturday (1145).
Manager Arsene Wenger has been under fire for a lack of transfer activity, especially after a shock 3-1 home defeat by Aston Villa on Saturday, though he maintains reinforcements will be brought in before the transfer window shuts on Sept. 2.

Married women dominate shock report on unsafe abortions

Director of Medical Services Dr Francis Kimani (left) and a member of the Medical Practitioners and Dentists Board Dr Samson Wanjala during the launch of the Abortion Report at a Nairobi hotel.
Nairobi, Kenya: An astonishing 465,000 unsafe abortions were procured by Kenyan women last year, according to a national survey released Wednesday.

More shocking for Kenyan families is data showing that majority of those seeking backstreet services were married women while girls as young as 10 were also captured in the survey data.
The report launched Wednesday showed that 64.4 per cent of married women or those living with their partners sought post-abortion care in health facilities while 27.8 per cent have never been married and 7.5 per cent were divorced.
It further revealed that among those seeking after-abortion care in health facilities, 16.5 per cent were girls aged between 10 and 19; 31.7 per cent were aged between 20 and 24 while the other half were over 25 years.
The report released Wednesday by the Director of Medical Services Dr Francis Kimani says last year’s count was up from less than 300,000 a decade ago.
In December a Google report confirmed that the Internet search query “How to procure an abortion” was the most popular of all searches by Kenyans.
The Google Zeitgeist 2012 report showed the number one trending search in the “how to” category was by Kenyans seeking information on how to abort.
The study carried out by the Ministry of Health, African Population and Health Research Center, Ipas, and Guttmacher Institute shows that induced abortions cut across all reproductive age groups, religions, social status and education even pulling in girls as young as 10.
“More shocking is the finding that among women aged 19 or younger who came to a health facility for post-abortion care, 45 per cent experienced severe complications,” said Kimani during the launch.
Organ failure
However the rates of abortion vary from region to region with Rift Valley at the top followed by Nyanza and Western. While nearly 120,000 women were treated for health complications resulting from unsafe abortions last year, 38,687 and 36,842 of these were from Nyanza and Western respectively.

Gladys Shollei reveals her battles with Ahmednasir Abdullahi and JSC team

Judiciary Chief Registrar Gladys Boss Shollei.
Nairobi, Kenya: Judiciary Chief Registrar Gladys Shollei Wednesday lifted the lid on her stormy fall-out with three members of the Judicial Service Commission (JSC) she suspects to be behind her woes.

Shollei admitted to strained relations with the outspoken member of the commission, Ahmednasir Abdullahi, Judge Mohammed Warsame and Chief Magistrate Emily Ominde.
Appearing before a parliamentary committee in Nairobi Wednesday, Shollei candidly revealed the challenges she has had dealing with the three JSC members, citing instances of interference in her work by the commissioners.
The Chief Registrar told the National Assembly’s Legal Affairs Committee that she had reported the poor working Willy Mutunga.
She accused Abdullahi of interfering with the Judiciary’s search for an office block in Mombasa to host the Court of Appeal, intimating that the lawyer wanted to advance his interests and dictate the space that the institution should rent.
“When I told him of the house we wanted to rent, and which was proposed to us by the LSK Mombasa, he told me wachana na hiyo nyumba, nitakutafutia ingine (forget about that building, I will show you another one),” Shollei told MPs.
Shollei said that she has had difficulties dealing with the lawyer at the official level for months, and had reported the matter to CJ Mutunga.
“It could be for this Mombasa house (that she is being targeted for removal from office). Many people know of this incident,” she said.
Abdullahi represents the Law Society of Kenya (LSK) in the JSC.
She accused Warsame, an Appellate judge, of seeking employment favours from her, claiming that the Judge had complained that since she assumed the position she had not given vacancies to them as was the case before.
“Judge Warsame was always taunting me for not employing his people in the Judiciary. He once told me wewe kutoka uingie hatujawahi kula matunda ya uhuru kutoka kwako (We have never enjoyed the fruits since you assumed office).”

Kenya signed agreements worth $5 billion (Sh425 billion) with China on Monday.
On the same day, President Kenyatta was accorded a formal welcome including a 21-gun salute at the Great Hall of the People, the most iconic building in China.
Some $4 billion will cover economic partnerships, wildlife protection, and the standard gauge railway linking the port of Mombasa and the border town of Malaba, which President Kenyatta said would provide better access to markets for goods from Kenya as well as Uganda, Rwanda, Burundi and the eastern part of the Democratic Republic of the Congo.
Another $1 billion was slated for energy-related projects.
“These agreements deepen our practical cooperation,” President Xi Jinping told President Kenyatta shortly before the agreements were signed.
“China supports Kenya’s quest for industrialisation,” the Chinese leader added.
Speaking in Beijing during bilateral discussions dominated by business and investment partnerships in Kenya’s economy, President Kenyatta invited Chinese investors to look at opportunities in Kenya’s 47 counties, in oil and gas, power generation, Lamu Port-South Sudan-Ethiopia Transport project (Lapsset) and the technology city at Konza, near Nairobi.
VISION 2030
He said China was playing a critical role in the realization of Vision 2030, especially in the execution of capital-intensive flagship projects.
President Xi said China was also exploring other areas of investment, including agribusiness, irrigation, fertilizer production and purchases, and technology.
The Chinese leader said his country would also support Kenya’s plans to host a clearing house for the Chinese renminbi currency in Nairobi – greatly boosting the Kenyan capitals credentials as a leading financial hub.
Presidents Xi and Kenyatta pledged to increase contact between China’s ruling party and Kenya’s ruling Jubilee coalition. They agreed that party-to-party contact was essential to bolster political and economic partnerships.

She has had S*X with Citizen TV’s JANET MBUGUA’s boyfriend, MUSIKARI KOMBO, JAMES OSWAGO and RAILA’s aide

Monday August 19, 2013 - To many Kenyans, a woman who sleeps with more than one man is called a “prostitute”, but for this woman who has slept with over 5 prominent Kenyans, she is called a diplomat.

On Saturday, Nairobi lawyer, Douglas Mango, claimed that Kenya’s Deputy Ambassador to Somalia, Yvonne Khamati, is a high profile prostitute who sleeps with the high and mighty in the country to attain her goals.

According to the lawyer, Yvonne is alleged to have slept with Ford Kenya bigwig, Musikari Kombo, Independent Electoral and Boundaries Commission (IEBC) Chief Executive Officer, James Oswago, political broker and Citizen TV’s Janet Mbugua’s boyfriend Gor Semelango, and former Prime Minister Raila Odinga's aide whom the lawyer refused to mention (but credible sources have it that it is Carolli Omondi).

The lawyer also alleges that he has credible photos of Oswago nailing Khamati at one of his loos at the IEBC headquarters.

He also alleges Oswago requested Khamati a s3xual favour in order to grant her a Sh 23 million election oversight tender.

Douglas Mango is an ODM sympathiser and a close ally of the former PM.

Man opposed to inheritance allegedly kills step-father

TAITA, KENYA: Police have arrested a middle aged man for allegedly killing his step father over inheritance saga in Taita-Taveta County.

According to police, the suspect was against the marriage of her mother to the deceased identified as Emmanuel Mutie, 45.
The County Police Commandant Richard Bitonga said the suspect murdered the deceased after he found him with his mother at their home in Chumvini in Taveta district last night.
“The suspect has been against the marriage of his mother to the deceased after his father died four years ago. There has always been bad blood between the suspect and his deceased step father,” said the police boss.
“What annoyed the suspect is when he found the deceased with his mother in the house. He confronted him and chased him out of the house. The suspect later killed the deceased a few meters away from their house,” said Mr Bitonga.
Speaking to The Standard on Tuesday, the police boss said the body of the deceased was found lying in a pool of blood along the road by members of the public who alerted police.
“The deceased was slashed several times with a machete because the body had deep cuts,” he said.
The body was later removed and taken to Taveta district hospital for postmortem, he said.
“The suspect is in our custody and investigations into the 8 pm incident had been launched. We will take him to court once we are through with our investigations,” added the police boss.

Ruto ordered to attend trial hearings pending determination of prosecutor’s appeal

Kenya: The International Criminal Court ( ICC) Appeal Chamber has ordered Deputy President William Ruto to attend all trial hearing pending until an appeal filed by the prosecutor is determined.

ICC prosecutor Fatou Bensouda had appealed a decision by the court to ‘excuse Ruto from continued presence during the trial, with the exception of specified hearings at which his attendance is required.
“The Appeals Chamber recalls that, as far as article 82 (3) of the Statute is concerned, "[suspension involves the non-enforcement of a decision, the subject of 1 s an appeal". Therefore, without prejudice to the Appeals Chamber's ultimate decision on the merits of the Prosecutor's appeal, the grant of suspensive effect of the Impugned Decision would result in Mr Ruto being required to be present during the trial, pending the final determination of the Prosecutor's appeal”, read part of the ICC statement signed by Judge Akua Kuenyehia on behalf of the Presiding Judge.

Narok, Kenya: There was drama as Deputy President, William Ruto and Bomet County governor, Isaac Ruto clashed publicly over the raging clamour for constitutional referendum on devolution. 0

The duo who shared a podium at Emurua Dikirr primary school in Narok County at the weekend during the homecoming party of Emurua Dikirr constituency MP, Johana Ngeno sharply differed on the referendum issue.
The deputy president who led more than 15 MPs allied to the Jubilee coalition launched scathing attack on the proponents of the push for referendum saying Kenyans were not ready to be subjected to another political campaign when they were yet to settle after the recent general election.
Isaac who appeared angered by the comments made by the  Jubilee legislators in attendance said nothing would stop him from his push for the referendum and that he was ready for any eventuality including threats to eject him  from the coalition.
He downplayed the accusations levelled against him that he was being used by the Cord coalition to undermine the government noting that his agenda was clear and void of any political hand.
“Mine is simple and clear on devolution and I must not kneel down to anyone to demonstrate my point. The central government should be honest and stop taking us in circles on what is clear to every Kenyan. Nothing will stop us from asking for the 40% revenue for the County governments,” said Ruto.
Disrupting devolution
He said having realized the laxity and non commitment by the central government to implement devolution as required, governors have set up a plan of collecting 1 million signatures in readiness for a referendum.
Ruto who is also the chairman of summit of governors said he was in Jubilee to stay but would not keep mum on whoever shows intention of disrupting devolution.
“To start moving around the country and branding others traitors when they ask for more resources to be devolved was an archaic way of thinking and mere hoodwinking of Kenyans,” noted Isaac.
He said as governors they wanted to have a strong senate which can effectively play the oversight role on the operation of county governments and accused the national assembly of trying to hijack the process from the upper house.

Study: Employees who have sex four times a week get paid more than those who don't

Updated Friday, August 16th 2013 at 18:29 GMT +3 Enjoying a fulfilling sex life could be the key to earning a healthy wage, new research suggests.
It found that people who have sex at least four times a week get paid more than people who do not have as much sex.

Not having enough sex can also lead to people suffering loneliness, social anxiety and depression, the researchers found.

People who have sex at least four times a week get paid more than people who do not have as much sex. Not having enough sex can also lead to depression, loneliness and social anxiety
‘People need to love and be loved (sexually and non-sexually) by others.
'In the absence of these elements, many people become susceptible to loneliness, social anxiety, and depression that could affect their working life,’ study author Dr Nick Drydakis, an economics lecturer at Anglia Ruskin University, told CBSNews.
Dr Drydakis says he decided to study the topic because he believes that people have to meet their basic needs, such as eating, drinking, sleeping and having sex, before they will be able to have successes in other parts of their life.
He studied data from 7,500 people aged between 26 and 50.
The participants, who included both straight and gay couples, were asked about their health, sexual activity, employment status and earnings.
The findings revealed that people who have sex more than four times a week earn five per cent more than those who have sex less than four times a week.
The study also found that people who do not have sex at all earn three per cent less than people who do have sex.

Ruto team allowed to challenge ICC case

PHOTO | FILE ICC prosecutor Fatou Bensouda when she visited Kenya in October 2012. The court has allowed Mr Ruto’s lawyers to make submissions on why the case against him should be thrown out.
In Summary
  • Judges give new trial guidelines as crimes against humanity case facing Deputy President set to begin on September 10

Forty two witnesses have been lined up to testify against Deputy President William Ruto when his case opens at the International Criminal Court in The Hague next month.
Ms Fatou Bensouda, the ICC prosecutor, had initially planned to call 46 witnesses and use 413 hours to build her case against Mr Ruto and former radio journalist Joshua arap Sang. However, four witnesses have withdrawn their testimony while the court has described the hours sought by Ms Bensouda as “excessive”.
Mr Ruto and Mr Sang face crimes against humanity charges over the 2007-2008 post-election violence.
Some 1,133 Kenyans were killed and more than 500,000 uprooted from their homes in the chaos that ensued after the presidential election results were disputed.
Incumbent Mwai Kibaki of the PNU was declared winner but ODM’s Raila Odinga, his key challenger, cried foul saying the vote had been stolen.
Mr Ruto and Mr Sang, who were on the ODM side, are said to have incited, financed and executed the chaos.
Their case opens on September 10 at The Hague in the Netherlands. Mr Ruto will be required to be present in court when the prosecutor makes her opening statements.
Also facing similar charges is President Uhuru Kenyatta, who was on the PNU side and whose case opens on November 12.
The three judges hearing Mr Ruto’s case have allowed his lawyers to move a motion of “no-case-to answer” once Ms Bensouda concludes her submissions.
No case to answer
“The Chamber will, in principle, permit the defence to enter submissions, at the close of the case for the prosecution, asserting that there is no case for it to answer at the end of the prosecution’s presentation of evidence,” the judges said in their latest verdict dated August 9 but sent to the Nation on Monday.
Trial Chamber judges Chile Oboe-Osuji, Olga Herrera Carbuccia and Robert Fremr said they would give reasons for inviting Mr Ruto’s lawyers to make the submissions seeking to end the case.
They also said that Mr Ruto and Mr Sang would be given the opportunity to give their personal statements before the court.
The judges also provided for the possibility of visiting one of the post-election hotspots should any of the parties in the case make a request for such a visit.
“As a result of subsequent changes, there are currently 42 witnesses whom the prosecution intends to call. The Chamber is of the view that the prosecution’s estimates appear excessive.
“At the next status conference to be held, the Chamber will seek the parties’ and participants’ views on this issue, with a view to reducing the prosecution’s estimates,” the judges said.
They said opening statements by the prosecution, defence and lawyers for victims would each take two hours although legal teams for Mr Ruto and Mr Sang have been asked to agree on how they will utilise their time, including making provision for their clients to give personal statements.
“The Ruto defence and Sang defence may choose to re-distribute the combined time allowed for defence opening statements and allocate the time amongst themselves as they see fit. Any statements from the accused persons should be made within the allotted time,” they said.
