Gladys Shollei reveals her battles with Ahmednasir Abdullahi and JSC team

Nairobi, Kenya: Judiciary Chief Registrar Gladys Shollei Wednesday lifted the lid on her stormy fall-out with three members of the Judicial Service Commission (JSC) she suspects to be behind her woes.

Shollei admitted to strained relations with the outspoken member of the commission, Ahmednasir Abdullahi, Judge Mohammed Warsame and Chief Magistrate Emily Ominde.
Appearing before a parliamentary committee in Nairobi Wednesday, Shollei candidly revealed the challenges she has had dealing with the three JSC members, citing instances of interference in her work by the commissioners.
The Chief Registrar told the National Assembly’s Legal Affairs Committee that she had reported the poor working Willy Mutunga.
She accused Abdullahi of interfering with the Judiciary’s search for an office block in Mombasa to host the Court of Appeal, intimating that the lawyer wanted to advance his interests and dictate the space that the institution should rent.
“When I told him of the house we wanted to rent, and which was proposed to us by the LSK Mombasa, he told me wachana na hiyo nyumba, nitakutafutia ingine (forget about that building, I will show you another one),” Shollei told MPs.
Shollei said that she has had difficulties dealing with the lawyer at the official level for months, and had reported the matter to CJ Mutunga.
“It could be for this Mombasa house (that she is being targeted for removal from office). Many people know of this incident,” she said.
Abdullahi represents the Law Society of Kenya (LSK) in the JSC.
She accused Warsame, an Appellate judge, of seeking employment favours from her, claiming that the Judge had complained that since she assumed the position she had not given vacancies to them as was the case before.
“Judge Warsame was always taunting me for not employing his people in the Judiciary. He once told me wewe kutoka uingie hatujawahi kula matunda ya uhuru kutoka kwako (We have never enjoyed the fruits since you assumed office).”

Kenya signed agreements worth $5 billion (Sh425 billion) with China on Monday.
On the same day, President Kenyatta was accorded a formal welcome including a 21-gun salute at the Great Hall of the People, the most iconic building in China.
Some $4 billion will cover economic partnerships, wildlife protection, and the standard gauge railway linking the port of Mombasa and the border town of Malaba, which President Kenyatta said would provide better access to markets for goods from Kenya as well as Uganda, Rwanda, Burundi and the eastern part of the Democratic Republic of the Congo.
Another $1 billion was slated for energy-related projects.
“These agreements deepen our practical cooperation,” President Xi Jinping told President Kenyatta shortly before the agreements were signed.
“China supports Kenya’s quest for industrialisation,” the Chinese leader added.
Speaking in Beijing during bilateral discussions dominated by business and investment partnerships in Kenya’s economy, President Kenyatta invited Chinese investors to look at opportunities in Kenya’s 47 counties, in oil and gas, power generation, Lamu Port-South Sudan-Ethiopia Transport project (Lapsset) and the technology city at Konza, near Nairobi.
VISION 2030
He said China was playing a critical role in the realization of Vision 2030, especially in the execution of capital-intensive flagship projects.
President Xi said China was also exploring other areas of investment, including agribusiness, irrigation, fertilizer production and purchases, and technology.
The Chinese leader said his country would also support Kenya’s plans to host a clearing house for the Chinese renminbi currency in Nairobi – greatly boosting the Kenyan capitals credentials as a leading financial hub.
Presidents Xi and Kenyatta pledged to increase contact between China’s ruling party and Kenya’s ruling Jubilee coalition. They agreed that party-to-party contact was essential to bolster political and economic partnerships.

According to the lawyer, Yvonne is alleged to have slept with Ford Kenya bigwig, Musikari Kombo, Independent Electoral and Boundaries Commission (IEBC) Chief Executive Officer, James Oswago, political broker and Citizen TV’s Janet Mbugua’s boyfriend Gor Semelango, and former Prime Minister Raila Odinga's aide whom the lawyer refused to mention (but credible sources have it that it is Carolli Omondi).

The lawyer also alleges that he has credible photos of Oswago nailing Khamati at one of his loos at the IEBC headquarters.

He also alleges Oswago requested Khamati a s3xual favour in order to grant her a Sh 23 million election oversight tender.

Douglas Mango is an ODM sympathiser and a close ally of the former PM.

Man opposed to inheritance allegedly kills step-father


TAITA, KENYA: Police have arrested a middle aged man for allegedly killing his step father over inheritance saga in Taita-Taveta County.

According to police, the suspect was against the marriage of her mother to the deceased identified as Emmanuel Mutie, 45.
The County Police Commandant Richard Bitonga said the suspect murdered the deceased after he found him with his mother at their home in Chumvini in Taveta district last night.
“The suspect has been against the marriage of his mother to the deceased after his father died four years ago. There has always been bad blood between the suspect and his deceased step father,” said the police boss.
“What annoyed the suspect is when he found the deceased with his mother in the house. He confronted him and chased him out of the house. The suspect later killed the deceased a few meters away from their house,” said Mr Bitonga.
Speaking to The Standard on Tuesday, the police boss said the body of the deceased was found lying in a pool of blood along the road by members of the public who alerted police.
“The deceased was slashed several times with a machete because the body had deep cuts,” he said.
The body was later removed and taken to Taveta district hospital for postmortem, he said.
“The suspect is in our custody and investigations into the 8 pm incident had been launched. We will take him to court once we are through with our investigations,” added the police boss.


Ruto ordered to attend trial hearings pending determination of prosecutor’s appeal


Kenya: The International Criminal Court ( ICC) Appeal Chamber has ordered Deputy President William Ruto to attend all trial hearing pending until an appeal filed by the prosecutor is determined.

ICC prosecutor Fatou Bensouda had appealed a decision by the court to ‘excuse Ruto from continued presence during the trial, with the exception of specified hearings at which his attendance is required.
“The Appeals Chamber recalls that, as far as article 82 (3) of the Statute is concerned, "[suspension involves the non-enforcement of a decision, the subject of 1 s an appeal". Therefore, without prejudice to the Appeals Chamber's ultimate decision on the merits of the Prosecutor's appeal, the grant of suspensive effect of the Impugned Decision would result in Mr Ruto being required to be present during the trial, pending the final determination of the Prosecutor's appeal”, read part of the ICC statement signed by Judge Akua Kuenyehia on behalf of the Presiding Judge.

Narok, Kenya: There was drama as Deputy President, William Ruto and Bomet County governor, Isaac Ruto clashed publicly over the raging clamour for constitutional referendum on devolution. 0



The duo who shared a podium at Emurua Dikirr primary school in Narok County at the weekend during the homecoming party of Emurua Dikirr constituency MP, Johana Ngeno sharply differed on the referendum issue.
The deputy president who led more than 15 MPs allied to the Jubilee coalition launched scathing attack on the proponents of the push for referendum saying Kenyans were not ready to be subjected to another political campaign when they were yet to settle after the recent general election.
Isaac who appeared angered by the comments made by the  Jubilee legislators in attendance said nothing would stop him from his push for the referendum and that he was ready for any eventuality including threats to eject him  from the coalition.
He downplayed the accusations levelled against him that he was being used by the Cord coalition to undermine the government noting that his agenda was clear and void of any political hand.
“Mine is simple and clear on devolution and I must not kneel down to anyone to demonstrate my point. The central government should be honest and stop taking us in circles on what is clear to every Kenyan. Nothing will stop us from asking for the 40% revenue for the County governments,” said Ruto.
Disrupting devolution
He said having realized the laxity and non commitment by the central government to implement devolution as required, governors have set up a plan of collecting 1 million signatures in readiness for a referendum.
Ruto who is also the chairman of summit of governors said he was in Jubilee to stay but would not keep mum on whoever shows intention of disrupting devolution.
“To start moving around the country and branding others traitors when they ask for more resources to be devolved was an archaic way of thinking and mere hoodwinking of Kenyans,” noted Isaac.
He said as governors they wanted to have a strong senate which can effectively play the oversight role on the operation of county governments and accused the national assembly of trying to hijack the process from the upper house.

It found that people who have sex at least four times a week get paid more than people who do not have as much sex.

'In the absence of these elements, many people become susceptible to loneliness, social anxiety, and depression that could affect their working life,’ study author Dr Nick Drydakis, an economics lecturer at Anglia Ruskin University, told CBSNews.
Dr Drydakis says he decided to study the topic because he believes that people have to meet their basic needs, such as eating, drinking, sleeping and having sex, before they will be able to have successes in other parts of their life.
He studied data from 7,500 people aged between 26 and 50.
The participants, who included both straight and gay couples, were asked about their health, sexual activity, employment status and earnings.
The findings revealed that people who have sex more than four times a week earn five per cent more than those who have sex less than four times a week.
The study also found that people who do not have sex at all earn three per cent less than people who do have sex.

Forty two witnesses have been lined up to testify against Deputy President William Ruto when his case opens at the International Criminal Court in The Hague next month.
Ms Fatou Bensouda, the ICC prosecutor, had initially planned to call 46 witnesses and use 413 hours to build her case against Mr Ruto and former radio journalist Joshua arap Sang. However, four witnesses have withdrawn their testimony while the court has described the hours sought by Ms Bensouda as “excessive”.
Mr Ruto and Mr Sang face crimes against humanity charges over the 2007-2008 post-election violence.
Some 1,133 Kenyans were killed and more than 500,000 uprooted from their homes in the chaos that ensued after the presidential election results were disputed.
Incumbent Mwai Kibaki of the PNU was declared winner but ODM’s Raila Odinga, his key challenger, cried foul saying the vote had been stolen.
Mr Ruto and Mr Sang, who were on the ODM side, are said to have incited, financed and executed the chaos.
Their case opens on September 10 at The Hague in the Netherlands. Mr Ruto will be required to be present in court when the prosecutor makes her opening statements.
Also facing similar charges is President Uhuru Kenyatta, who was on the PNU side and whose case opens on November 12.
The three judges hearing Mr Ruto’s case have allowed his lawyers to move a motion of “no-case-to answer” once Ms Bensouda concludes her submissions.
No case to answer
“The Chamber will, in principle, permit the defence to enter submissions, at the close of the case for the prosecution, asserting that there is no case for it to answer at the end of the prosecution’s presentation of evidence,” the judges said in their latest verdict dated August 9 but sent to the Nation on Monday.
Trial Chamber judges Chile Oboe-Osuji, Olga Herrera Carbuccia and Robert Fremr said they would give reasons for inviting Mr Ruto’s lawyers to make the submissions seeking to end the case.
They also said that Mr Ruto and Mr Sang would be given the opportunity to give their personal statements before the court.
The judges also provided for the possibility of visiting one of the post-election hotspots should any of the parties in the case make a request for such a visit.
“As a result of subsequent changes, there are currently 42 witnesses whom the prosecution intends to call. The Chamber is of the view that the prosecution’s estimates appear excessive.
“At the next status conference to be held, the Chamber will seek the parties’ and participants’ views on this issue, with a view to reducing the prosecution’s estimates,” the judges said.
They said opening statements by the prosecution, defence and lawyers for victims would each take two hours although legal teams for Mr Ruto and Mr Sang have been asked to agree on how they will utilise their time, including making provision for their clients to give personal statements.
“The Ruto defence and Sang defence may choose to re-distribute the combined time allowed for defence opening statements and allocate the time amongst themselves as they see fit. Any statements from the accused persons should be made within the allotted time,” they said.

Uhuru wants ICC trial held in Nairobi or Dar Es Salaam

President Uhuru Kenyatta wants portions of his trial before the International Criminal Court ( ICC) to be held either in Kenya or Tanzania.

 Mr Kenyatta’s defence said although Article 62 of the Rome Statute provided that the place of the trial shall be the seat of the Court (The Hague), Rule 100(1) confirmed that “where the Court considers that it would be in the interests of justice, it may decide to sit in a State other than the host State.”
 “The defence does not object to the Chamber holding the opening of the trial or another appropriate portion of the trial in Kenya or Tanzania,” Kenyatta’s lawyer Steven Kay submitted in a filing to the ICC yesterday.
 “The defence also notes that on February 7 2013, neither the Registry nor the prosecution objected in principal to the Chamber holding appropriate portions of the trial in Kenya and/or Tanzania,” added the president’s defence.
 The filing was in response to the Trial Chamber’s order for further observations on where the court shall sit for trial.
 Last month, the ICC judges directed parties to President Kenyatta’s case to make submissions on where the court will sit for trial.

The sales assistant who refused to show U.S. talkshow billionaire Oprah Winfrey a luxury handbag costing nearly £25,000 claims the superstar lied about what happened in the luxury Swiss boutique where she works.

Speaking anonymously to Sunday newspaper SonntagsBlick, the Italian bag lady said she felt 'powerless' and in the grip of a 'cyclone' after Winfrey went on TV in America to claim she had been the victim of racism.
Winfrey was in Switzerland in July when she walked into the Trois Pommes boutique in Zurich looking for a handbag to match the outfit she was going to wear to old friend Tina Turner's wedding.
She claims the sales assistant refused to show her the black crocodile leather bag because - seeing a black woman - she automatically assumed she would not be able to afford it.
Now the saleslady has hit back, stating: 'I wasn't sure what I should present to her when she came in on the afternoon of Saturday July 20 so I showed her some bags from the Jennifer Aniston collection.
'I explained to her the bags came in different sizes and materials, like I always do.
'She looked at a frame behind me. Far above there was the 35,000 Swiss franc crocodile leather bag.
'I simply told her that it was like the one I held in my hand, only much more expensive, and that I could show her similar bags.
'It is absolutely not true that I declined to show her the bag on racist grounds. I even asked her if she wanted to look at the bag.

Six fishermen feared dead in Turkana militia attack, boats seized


Turkana, Kenya: Six fishermen are feared dead following a fresh attack by suspected Merille militia in Todonyang, along the Kenya-Ethiopia border.

Turkana DC Erick Wanyonyi said they had received information of the killing of the six fishermen in Lake Turkana.
The DC said the militia from Ethiopia also seized five boats belonging to the Kenyan fishermen who were fishing in the lake, escalating tension in the area.
This is the second incident in a week after the militia abducted four fishermen and seized their boat at Kanamkuny beach in Todonyang border point. The four are still missing.
The attacks come even after local NGOs among them Elemi Conflicts Resolution Development Project (ECOREDEP) and Conflicts Early Warning Mechanism (CEWARN) that spearhead peace in the region had raised alarm over impending attacks by the militia and asked the Government to act.
Wanyonyi said the militia seized the boats and the fishing gears in Todonyang beach when they ambushed the six fishermen in the middle of the Lake.
Police deployed
He said unconfirmed reports indicated that the militia opened fire at the fishermen before seizing the boats.
“We have since mobilised a serious operation in the area in response to these attacks”, Wanyonyi told The Standard.
The DC said a contingent of security personnel including General Service Unit (GSU), Regular police and the rapid deployment Unit (RDU) have been deployed to Lake Turkana to respond to the attacks.
“We have deployed security personnel on the ground to pursue the attackers and recover the stolen boats," the DC said.

Imported vehicles’ port coming soon



Mombasa, Kenya: Deputy President William Ruto has announced the Government will construct a port in Mombasa for imported vehicles.

Ruto said the Government is in the process of identifying 500 acres of land at Mazeras town for establishment of the multimillion shilling dry port for imported vehicles mainly from Japan.
“We have agreed with exporters in Japan that instead of taking their vehicles to Dubai free port, they should bring them to Mombasa,” Ruto said.
Ruto further told Mombasa County leaders that the national government will soon hold a special bilateral meeting with Mombasa County government to discuss various development projects that include infrastructure and congestion of the road from Mombasa International Airport.
“We want to make the entry to Mombasa more attractive. We are determined to clear congestion,” said Ruto, who was speaking during a meeting with county leaders at the weekend.
Ruto pledged that the Government will build a dual carriageway from the airport to Mombasa island in the next two years to ease traffic jams.
Free port
Present at the meeting were Mombasa Governor Hassan Joho, Senator Hassan Omar, Woman representative Mishi Juma Mboko, Nyali MP Awiti Bolo and Mvita MP Abdulswamad Nassir, among others.
Ruto noted President Uhuru Kenyatta’s intervention to clear cargo congestion at the port of Mombasa has borne fruit in the last one month as performance has improved.
“Improvement at the port in the last one month has not been seen in years,” Ruto said.
He added the Government was determined to make the port an attractive international competitive facility. Ruto said Cabinet Secretary for Industrialisation Mohamed Adan was in the process of identifying firms for the Dongo-Kundu free port project. About Sh30 billion is set for the free port project.

Plans underway to merge Jubilee, Amani coalitions' manifestos


MIGORI, KENYA: Plans are underway to merge Jubilee and Amani coalitions’ manifestos for better development programmes in the country, President Uhuru Kenyatta’s chief political affairs adviser Joshua Kuttuny has said.

Speaking in Migori County on Monday, Kuttuny said the move was to ensure that Kenyans end up with the best policies possible in a bid to move the country forward.
“We know that all the coalitions had good plans for the country and we cannot ignore their manifestos,” he said, adding that the initiative will see the government come up with one major plan which contains what is desired across the country.
He said the government would also look at the Coalition for Reforms and Democracy ( CORD) manifesto to ensure that they do not miss anything aimed at helping improve the lives of Kenyans.
At the same time, Kutuny defended the government against accusations by sections of leaders that it was not doing enough to aid devolution as envisioned in the constitution, saying the facts on the ground were that the government was actually doing more than what is said in the constitution.
“Let us look at what the president has already done for devolution within the past three months alone and know its commitment to devolution,” he said, adding that those saying the president was not for devolution were not being honest.
He at the same time urged the Governors to drop their demand for a referendum on devolution, saying there was no need for anyone to fear that devolution would be undermined.
According to the former Cherengany MP, although the constitution provided for 15 percent of the country’s budget to go to the counties, the government had actually taken more than double of that to the devolved governments.
“We are seeing over 30 percent going to the counties and we urge our Governors to be patient and let the government go on with devolution. More money will be channeled to the counties to undertake projects by the national governments,” he said.
On the youth fund, he insisted that the Sh6 billion cannot be given to Members of Parliament to distribute in their areas, saying the MP’s could not be trusted to be fair when giving out the money.
“There must be a body charged with the distribution of this fund because the legislators will only end up giving it to their friends and those who supported them,” he claimed.

Nairobi, Kenya: National carrier Kenya Airways lost Sh340 million in revenues following the fire that gutted down Jomo Kenyatta International Airport’s international arrivals section, leading to its temporary closure last week.

Kenya Airways CEO Titus Naikuni also said by Sunday 492 passengers were stranded in Hong Kong following the Wednesday fire incident. He, however, said efforts were being made to fly them to their destinations.
“In terms of revenues, we have lost $4 million. The incident also left us with a huge pile-up, but we are catching up because we are at about 90 per cent of our normal flights,” he said.
Naikuni said, following the pile-up, there were 33 international airlines and 20 domestic ones lined up to leave Nairobi by Sunday.
Speaking when he toured the more than 10 tents that have been set up within the airport to help clear passengers and cargo for domestic and international airlines, Naikuni said the airline would conduct a further cost analysis of the fire at large next week.
He was accompanied by senior Kenya Airports Authority officials. He said they hope to be fully functional by Wednesday when lounges at the airport are opened. The lounges were full of soot following the fire.
Currently, domestic passengers are being cleared at the Cargo Centre of the airport while international ones are operating from tents that have been set up within the airport.
The leading airline operator has secured the Presidential Pavilion parade section and set up its base there for international arrivals.
The progress
Several tents have been erected there for major hotels, banks, mobile service providers, taxis and other service providers to ensure smooth transaction of services.
“I am impressed by the speed of the progress and we want to thank all those who have made it easy for this to happen,” said Naikuni.

We all wish we could take the place of the ailing person, but the best we can do is stay close to them, pray for them, and support them. For those who know my mother and sister, you are aware of the battles they are fighting, and you’ve committed to stick with them. For that, we want to thank you.
For those who don’t know them; I’ll begin with my mother (Beth Mumbi Thuita): She got sick on Dec 2nd, 1999. Through this, we found out that she had a brain aneurism, Meningitis, memory loss, hypertension, diabetes, and she lost her sight for 2 months. After the treatment, she got better, and was doing well until recently. She was told that she has a Hernia that needs surgery, and her diabetes has surged to the level at which she needs proper medical attention, to control the sugar levels. We were told that she would need KShs. 2.5m to undergo treatment.
As for my sister (Caroline Gachambi Thuita): She got her first seizure in January, 2010, when she was 20 years. The seizures progressed from once in 2 months to once a month, then to once a week to once after every few days. Medicines prescribed to her weren’t making her any better and multiple seizures were common to the point that in April 2013, she would have one every 15 minutes, and consequently, admitted in ICU. Currently, she is using a crutch and paralyzing on the left side of her body. She needs urgent medical attention as she is still getting multiple seizures. She has not been able to lead a normal life as a young adult, nor has she been able to go to campus after high school; she is basically confined to the house. All the Neurologists she’s seen, in Kenya, are considered the best at their fields, and have advised that her condition needs to seek treatment in South Africa.
As it is tough to ask for help, I heed to the words of Paulo Coehlo: “When a person really desires something, all the universe conspires to help that person realize his/her dream”. Our family’s dream is to have it complete; as it once was. If you can find it within yourself to make that dream happen for us, then you are a part of the miracle that God has sent to make it happen.

Shock as Murang’a trio defile pig to death


pigShock has gripped Murang’a county after unconfirmed reports appeared on social media indicating that three men had allegedly raped a pig to death. It is reported that 38-year old Erastus Maina and two of his friends took turns defiling the pig Saturday night.

The news comes scarcely three weeks after four men in Kamahuha, Murang’a County s3xually abused a donkey to death in drunken licentiousness. Used condoms of different varieties were found next to the corpse of the donkey.

The latest incident has been greeted with shock and outrage on social media.

Girl who uses medical marijuana to help treat epilepsy, seizures


When you think of the stereotypical medical marijuana user, Charlotte Figi may be the last person that comes to mind.
That's because Charlotte is 6 years old.

She also suffers from debilitating seizures as a result of a rare form of epilepsy, a condition that's driven the family through just about every possible treatment, searching for some form of normalcy.
Desperate for options, Charlotte's dad, Matt, told CNN they took her to a specialist who recommended a highly specialized diet. That helped slightly, for a while until "at one point she was outside eating pine cones and stuff, all kinds of different things," Matt said. "As a parent you have to say, let's take a step back and look at this. Is this truly beneficial treatment because of these other things?"
With no other choices, the family explored cannabis oil -- an unconventional treatment, to say the least -- but they told KDVR it worked immediately.
According to a blog by Charlotte's mom, Paige, her daughter's seizures fell from 300 a week to around 3 over an 8 month period. She does note the program was first approved by a team of neurologists and pediatricians. Other benefits:

Her severe autism-like behaviors of self-injury, stimming, crying, violence, no eye contact, zero sleep, lack of social contact ... are a thing of the past. Charlotte is highlighted in a CNN documentary set to air this weekend, in which Sanjay Gupta, the news network's chief medical expert, engages in a national conversation about marijuana.
On Wednesday, Gupta apologized for having "misled" Americans regarding the effects of the drug. He's also penned an article titled, "Why I changed my mind on weed."

Untold story of Kenya’s biggest mining contract

Kenya: A director of Erad Suppliers seeking to auction assets of the cereals board over a Sh600 million debt owns shares in a mining firm whose licence was cancelled on Monday.

Documents in the possession of The Standard show that Mr Jacob Juma owns 30 per cent of Cortec Mining Kenya, a subsidiary of Canadian Pacifi c Wildcat Resources (PAW), a mineral exploration company.
Cortec Mining received the licence from the Government on March 26, the same day that the Supreme Court began hearing a petition by former Prime Minister Raila Odinga against the March 4 election of President Uhuru Kenyatta.
The licence was issued even as Kenyatta, then President-elect, ordered all ministers and Permanent Secretaries in the former Grand Coalition Government not to approve any contracts or licences on behalf of the incoming Jubilee government.
Cortec is among 31 mining firms whose licences were revoked by Mining Cabinet Secretary Najib Balala on Monday.
And it is now emerging that the discovery of niobium and rare earths in Kwale is at the centre of the cancellation of mining licences, The Standard has established.
Just a few days prior to its licence being cancelled, Cortec had announced the discovery of niobium and rare earths minerals whose value it estimated to be more than Sh51.2 trillion.
Managing Director David Anderson claimed the mineral find is the world’s sixth-largest reserve of the rare metal with a mine-life of up to 18 years.
Rare earths is used in modern technology including cars, phones, diode lights among others. Niobium is specifically used to make alloys for jet engines and to strengthen steel.
But Cortec has been in the crosshairs of government especially given its ownership structure and the nature of its licence.
A list of cancelled licences from the ministry singles out Cortec and another nondescript firm — Wanjala Mining Company Ltd — as operating under a special mining licence described as “the first of its kind.”
